Are Tiny Homes Legal In Georgia?

Yes! According to statewide building codes and regulations, tiny homes are legal in Georgia. However, this does not mean that every county has the same rules as the state or that tiny houses are legal in every part of Georgia. 

Georgia tiny home laws distinguish between four types of tiny homes. These are: 

  1. Tiny Homes on Wheels or Recreational Vehicles,
  2. Manufactured or Mobile Homes,
  3. Residential (Modular) Industrialized Buildings,
  4. and Site-Built Tiny Homes

Regulations for each of these different kinds of tiny homes vary, but they are all broadly defined as single-family homes that contain 400 sq ft of livable area or less. 

The state of Georgia has adopted the International Residential Code and the International Building Code as its mandatory building codes. In general, Georgia’s state building code applies to tiny homes that are site-built or modular. The code includes the adoption of Appendix Q, which provides guidance for tiny homes that are used as permanent residences. In Georgia, tiny house laws require homes to have a ceiling height of at least 6ft 8in in living spaces, 6ft 4in in bathrooms and kitchens, and 6ft 2in in stairways. If the tiny home includes a loft, it must be at least 35 sq ft in size, and an emergency escape, such as a skylight or roof window, is required. Each room may be no smaller than 70 sq ft, and all homes should be attached to water, sewage, and electrical utilities. 

Homes that are classified as recreational vehicles or mobile homes are not regulated by these same building codes; instead, they must follow the RV Industry Association Standards and the Department of Housing and Urban Development Code. Tiny homes on wheels are usually not considered permanent homes and, in most places in Georgia, are solely permitted in RV parks or campgrounds.

Does Calhoun County, GA allow tiny homes?

No. Tiny homes are not permitted in Calhoun County, Georgia. The county prohibits the construction of new homes that are smaller than 1,150 sq ft. However, this regulation could change as the Institute of Justice has filed a lawsuit against the county challenging the ban on tiny homes. Tiny homes on wheels are likely still allowed for temporary use in recreational vehicle parks, and mobile homes are permitted in some residential zones and mobile home parks with, at minimum, 800 sq ft of livable area. Check with your local area’s code of ordinances as regulations may change and laws vary between cities in Calhoun County.  

Does Clinch County, GA allow tiny homes?

As a rural county, Clinch County, Georgia, has varied regulations for tiny home builders and livers in the area. In Homerville, the largest city and the county’s seat, tiny homes are not permitted as single-family dwellings, and homes are required to have at least 1,536 sq ft. However, the county follows the International Residential Code (IRC), which only regulates habitable rooms as having at least 70 sq ft and being at least 7 ft high. Because regulations vary so widely, it is essential to check with your local area’s building office to confirm the specific requirements for your tiny home. 

Does Douglas County, GA allow tiny homes?

Unfortunately, Douglas County requires that homes must have a minimum of 1,800 square feet, which is much larger than tiny homes are typically considered or built. However, Douglas County does permit accessory structures with varying size requirements by zoning district. It is also possible that Douglas County allows tiny homes on wheels in recreational vehicle, campground, or mobile home parks on a temporary basis. Of course, regulations may vary between cities or towns, so it’s best to check your local planning and zoning offices for the most accurate rules for your area. 

Does Fannin County, GA allow tiny homes?

Tiny home laws are a hot topic in Fannin County, Georgia. Presently, Fannin County has a temporary law that prohibits the growth of tiny home subdivisions in the county. While the Georgia building code does allow tiny homes that are 400 sq ft and smaller with compliance with building and zoning codes, Fannin County continues to debate the benefits and drawbacks of tiny homes. It is currently unclear if tiny homes are allowed in unincorporated parts of Fannin County. The best course of action for someone interested in tiny living in Fannin, Georgia, is to contact local building and planning authorities to determine what the specific building regulations are for your most local area. 

Does Gordon County, GA allow tiny homes?

Unfortunately, Gordon County, Georgia, has banned homes smaller than 1,150 sq ft. However, the Institute of Justice has challenged this ban, which could lead to tiny homes being permitted in the county in the future. Accessory dwelling units are allowed in the county and must be no larger than 1,200 sq ft. Check with your local area’s regulations if you are considering building your next home in Gordon County. Does Henry County, GA allow tiny homes?

Henry County, Georgia, does not explicitly ban tiny homes in the county. However, it requires that homes have a minimum heated floor area of 1500 sq ft.  This is significantly larger than most tiny homes are typically considered. It is possible that tiny homes on wheels are allowed in the county on a temporary basis, such as in a recreational vehicle park or campground. It is also possible that regulations will change with time, so be sure to check before giving up the tiny home dream in Henry County!

Does Jackson County, GA allow tiny homes?

All dwellings in Jackson County, Georgia, must have a minimum heated gross floor area of 1,400 sq ft. This means that, at this time, tiny homes are not welcome in Jackson County. These regulations may change, so be sure to check your local area’s regulations frequently! 

Does Meriwether County, GA allow tiny homes?

It is unlikely that a tiny home would be allowed in Meriwether County, Georgia. While there is no explicit ban on tiny homes in the county, no home that is less than 1,375 sq ft is allowed in the county. Accessory dwelling units are permitted so long as they are no smaller than 500 sq ft. A permit is also required in Meriwether. Check your local area’s regulations as it is possible that a tiny home may be allowed in more rural parts of the county 

Does Pike County, GA allow tiny homes?

Unfortunately, tiny homes are not likely to be allowed in Pike County, Georgia. Pike County only permits residences with a minimum floor area of 1500 sq ft. Always double-check your local area’s tiny home regulations as laws change and vary by city or town.  

Does Polk County, GA allow tiny homes?

At this time, tiny homes are not allowed in Polk County, Georgia. However, this is likely to change as Polk County residents are currently petitioning the government to allow tiny homes and recreational vehicles. Accessory buildings are permitted in agricultural districts! 

Does Rockdale County, GA allow tiny homes?

Unfortunately, at this time, tiny homes are not allowed in Rockdale County, Georgia. The county requires permanent residences to have a minimum heated floor area of 1,600 or 1,800, depending on the district. This is much larger than what a tiny house would be. Regulations may change, and Rockdale could permit tiny homes on wheels on a temporary basis inside campgrounds and RV parks, so be sure to always double-check regulations!

Does Spalding County, GA allow tiny homes?

At this time, tiny homes are likely not allowed in Spalding County, Georgia. Spalding County requires that permanent residences have at least 2,000 sq ft. of livable floor area. Regulations may change with time, so be sure to check back! It’s also possible that more rural areas of Spalding County have fewer restrictions, so be sure to also confirm with your local area’s planning office what the regulations are for your specific location. 

Does Tattnall County, GA allow tiny homes?

At this time, Tattnall County prohibits tiny homes. This is a temporary moratorium until November 30, 2024. However, Tattnall County allows manufactured, modular, and mobile homes that meet the minimum housing standards of the county commissioners. It’s possible that tiny homes may soon be allowed in Tattnall County after the moratorium expires in a similar fashion as manufactured and mobile homes. 

Tiny Homes That Are Allowed in Georgia

In Georgia, the types of tiny homes that are generally allowed are: 

  • Permanent Tiny Homes are tiny homes that are constructed on a foundation, adhere to local building codes, and are located in specific residential zones. These homes must comply with all safety, zoning, and utility standards.
  • Tiny Homes on Wheels (THOWs) are tiny houses built on a trailer with wheels, are often considered recreational vehicles (RVs), and are commonly allowed in RV parks, campgrounds, or specific zoning areas that permit RV living. THOWs are also sometimes referred to as park models. 
  • Accessory Dwelling Units (ADUs) and Auxiliary Dwelling Units are not permitted as residences in every county in Georgia. However, in some counties and cities, they are legal. ADUs refer to additional dwelling areas on the same property as a primary residence. They can be attached to the primary dwelling or separate from the primary dwelling.

Generally, across the state, park model tiny homes are defined as vehicular-type units with a floor area of 400 sq ft or less. They are built to meet the ANSI A119.5, Park Model Recreational Vehicle Standard. Park models in Georgia can be semi or permanently sited! 

However, placing RVs, Park Models, and Tiny Homes on Wheels is regulated and controlled by local planning and zoning authorities. The Georgia Department of Transportation (GDOT) regulates RVs as vehicles for licensing purposes.
